SpaceXAI is being sued by a victim, who says that child porn created by her abusers was used to train Grok.
The lawsuit filed by Giard Sharp, Liberty Law, and Marsh Law firm accuses SpaceXAI (formerly xAI) of using a dataset that contained child sexual abuse material (CSAM) of the plaintiff, Jane Doe.
The plaintiff is referred to as Jane Doe to protect her identity.
Between the ages of 3 and 5, Doe was used to produce child pornography.
Those images have been on the CSAM Hash List maintained by the National Center for Missing and Exploited Children since the early 2000s.
Doe alleges that the same CSAM produced by her abusers was used in part to train SpaceXAI’s Grok, specifically its ability to generate images.
If such material were used in Grok’s training, it would likely influence the model, leading to “future abusive outputs” and leading to Doe’s “likeness (being) produced, transformed, and redistributed at scale,” the lawsuit, found by Arstechnica, reads.
Exploitative by design
Elon Musk’s SpaceXAI launched its generative AI model and specifically marketed the product as a provocative alternative to other competitors.
Grok was created to “answer almost anything,” and it “will also answer spicy questions that are rejected by most other AI systems,” the lawsuit reads.
Its following iterations, including Grok Imagine, continued in the same vein and were deliberately explicit.
Doe’s lawyers are accusing SpaceXAI of “incorporating explicit content generation into its business model” and Musk of encouraging “spicy” image generation.

As a result, there were an estimated 3 million sexualized images generated in January 2026, of which around 23,000 depicted children.
Following the backlash, Musk and SpaceXAI limited access to Grok’s text-to-image and video model to paid subscribers.
By limiting access to paid subscribers, Doe’s lawyers are accusing Musk and his company of profiting directly from the mass production of AI-generated child pornography.
“When faced with the flood of AI CSAM, the company moved its image and video-generating capabilities behind a paywall, turning abuse into a source of revenue," said Micha Liberty, who is representing Doe and owns Liberty Law.
Plaintiff wants to represent other victims
Doe is asking that this complaint be made into a class action lawsuit, in which a smaller group or individual fights on behalf of a wider group of victims.
She is also asking to be appointed as the representative, meaning she would function as the voice of a wider group, while her lawyer represents these victims.
The lawsuit demands that xAI be banned from generating, possessing, or distributing child pornography depicting Doe or any other victims who join the class action suit.
SpaceXAI will also be forced to destroy any CSAM already generated using Grok.
Doe is also seeking monetary damages, including actual damages, liquidated damages, and punitive damages, as well as interest on payments not made.
"xAI must be held responsible for knowingly training its models on images of the horrific abuse she suffered, and on the abuse images of every other survivor in this class," said Sarah London, a partner at Girard Sharp LLP.
